Terms of Service

These terms are an agreement between you and Threefold Interactive LLC ("Threefold Interactive", "we", "us"). They cover our games, the online features in those games, and this website.

By installing or playing one of our games, you agree to these terms. If you don't agree, don't play — and if you've bought the game, use the refund process of the store you bought it from.

Who can play

You need to be at least 13 years old to play our games or use their online features. If you're under the age of majority where you live, you need a parent or guardian's permission.

Your licence to the game

You don't buy the game itself — you buy a licence to play it. That licence is personal to you, non-exclusive, and can't be transferred except where the store you bought from allows it. It lasts as long as these terms are in force.

You may not:

• Sell, rent, sublicense, or redistribute the game or its files
• Reverse engineer, decompile, or disassemble it, except where the law explicitly gives you that right
• Remove or alter any copyright or ownership notices
• Use it commercially beyond the content-creation permission below

Online features

Some features depend on the platform you play through, and need an internet connection and a valid platform account. That covers cloud saves, achievements, and rift leaderboards, all handled through Steam. Asynchronous raids are planned; when they launch, the rules below apply to them too.

We'll do our best to keep them running, but we can't promise they'll always be available. Servers go down, get maintained, and get changed. We may modify, suspend, or discontinue online features, and if we ever retire them permanently we'll give reasonable notice where we can. The single-player game is designed to remain playable without them.

Fair play

Leaderboards and raids only work if the numbers mean something. You agree not to:

• Cheat, exploit bugs for advantage, or use trainers, bots, macros, or automation to produce results
• Modify the game or its memory to change what gets submitted
• Send falsified, replayed, or tampered data to our servers
• Interfere with our servers, or with other players' ability to play
• Share or sell accounts to inflate standings

We may remove leaderboard entries and raid contributions we believe are illegitimate, correct or reset standings, and end seasons or events. We may do this without notice, because announcing it in advance would defeat the purpose.

Suspension and termination

If you break these terms — particularly the fair play rules — we may suspend or permanently block your access to our online features. For anything other than serious or repeated abuse, we'll try to warn you first.

Losing access to online features doesn't refund your purchase, and doesn't stop you playing offline. If you think we've got it wrong, email us; we'd rather fix a mistake than defend one.

Videos, streams, and content creation

You may record, stream, and publish video of our games, including on monetised channels, and you may run ads or take subscriptions and donations against that content. You don't need to ask us and you don't owe us anything.

What you can't do is redistribute the game itself, its soundtrack, or its art as standalone files, pass our work off as your own, or use our name or logo in a way that suggests we endorse or sponsor you.

Mods and user content

If you make something using our games — mods, fan art, videos — you keep ownership of what you made. If you submit anything to us directly, such as feedback, bug reports, or suggestions, you give us permission to use it to improve our games without owing you payment or credit.

Anything you make public through the game, such as a name shown on a leaderboard, must not be unlawful, abusive, or deliberately offensive. We can remove content that is.

Purchases, refunds, and updates

Purchases are handled by the store you bought from, not by us, and refunds go through that store's process. See our support page for links.

We may release patches, updates, and balance changes at any time. Some updates are required in order to keep using online features. Balance changes can alter how the game plays, including in ways that affect existing saves or standings.

What we own

We own the games, their code, art, music, and the Threefold Interactive and Broken Divide names and logos, other than material we've licensed from others. Nothing in these terms transfers that ownership to you.

Warranty disclaimer

Our games and online features are provided "as is". To the extent the law allows, we don't promise they'll be uninterrupted, error-free, or fit for a particular purpose. Games have bugs, and we fix the ones we find.

Limitation of liability

To the extent the law allows, we aren't liable for indirect or consequential losses, lost data, or lost progress, and our total liability to you is limited to what you paid us for the game.

Your legal rights

Nothing in these terms takes away rights you have under the law where you live that can't be waived. Consumers in the European Union, the United Kingdom, and other places with mandatory consumer protection keep those rights in full, and where a term here conflicts with them, those rights win.

Privacy

Our privacy policy explains what we collect and why. Worth reading before you post a rift score, because leaderboards are public.

Governing law

These terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-law rules. If you're a consumer elsewhere, this doesn't deprive you of the protection of the mandatory laws of your own country.

Changes to these terms

We'll update these terms when what we do changes, and revise the "last updated" date above. If a change materially reduces your rights, we'll make a reasonable effort to tell you before it takes effect — continuing to play after that means you accept the new terms.
